April 18, 2013. In an otherwise light agenda, the Boone Town Council has more agenda items in closed session tonight, Thursday, April 18, than it does in open session.
Granted, the Boone Town Council did met on Tuesday, where 15 open-session items were on the agenda versus the spontaneous two-hour closed-session discussion for legal advice regarding threats of legal action from Watauga County Chairman Nathan Miller and his proposal to redistribute the sales tax on an ad valorem basis.
Among its four closed-session agenda items tonight is more discussion on the interrelated topics. Interrelated in the sense that Miller has said suing the Town of Boone is an option if the town’s regulations hinder the sale of the old Watauga High School property, which is why he proposed the redistribution of the sales tax – to punish the Town of Boone to the tune of $2 million or gain leverage with the Boone Town Council on the regulations of the old WHS site.
As listed on tonight’s agenda, which Town Clerk Kim Brown said has not changed as of noon on Thursday:
Closed Session (Pursuant to NCGS §143-318.11(a)(3):
A. Legal Advice – To consult with the Town Attorney in order to preserve the attorney/client privilege between the attorney and the Town Council and to consider and give instructions to the Town Attorney concerning the handling or settlement of a claim regarding the Highway 421 and Downtown lighting projects.
B. Legal Advice – To consult with the Town Attorney in order to preserve the attorney-client privilege between the attorney and the public body, which privilege is hereby acknowledged, to consider and give instructions concerning the handling or settlement of threatened judicial and administrative actions by the Watauga County Commission Chairman against the Town.
C. Legal Advice – To consult with the Town Attorney in order to preserve the attorney-client privilege between the attorney and the public body, which privilege is hereby acknowledged, to consider and give instructions concerning the handling of the collection of penalties against ADR Capital Management Inc. for UDO violations.
D. Legal Advice – To consult with the Town Attorney in order to preserve the attorney-client privilege between the attorney and the public body, which privilege is hereby acknowledged, to consider and give instructions concerning the handling or settlement of a lawsuit by Hellbender’s et al versus the Town of Boone.
As for the open-session items – other than the standard meeting formalities, the Boone Town Council will address board appointments for nine different boards and will hear Stacy Sears and Mary Sheryl Horine on the approval request of a special event permit for a ZAP Fitness 5K Race.
