Boone’s ETJ Powers in Jeopardy

By Paul T. Choate

Daniel Soucek

June 1, 2012. On Monday, June 4, the Boone Town Council will hold a special meeting at 7 p.m. to consult with town attorney Sam Furgiuele about the ramification of a recently introduced bill that could potentially strip Boone of extra-territorial jurisdiction (ETJ) powers.

The recent bill was proposed by State Sen. Daniel Soucek (R-Boone). State Sen. Ralph Hise (R-Spruce Pine) is co-sponsoring the bill.

As defined by Article 19 of General Statutes §160A, an ETJ is the area in a county outside of incorporated town limits that is subject to the town’s land use regulations.

Residents in an ETJ do not pay town taxes, but cannot vote in town elections nor receive town services.

The meeting will be held in the Council Chambers, located at 1500 Blowing Rock Road, Boone.
