May 17, 2012. From April 7 to May 1, the Boone Police Department received 7 noise complaints, six of which originated at the Boone Saloon and one at Paolucci’s. Currently, the Town of Boone is facing a lawsuit from Boone Saloon and Char regarding the noise ordinance.
Four of the past month’s complaints ended with no action taken by the Boone Police Department, either because the decibel readings weren’t over the limit for an extended time length or no noise violation was observed. On two of the seven complaints, the decibel-reading machines malfunctioned. The machines “failed to download the information and [were] sent back to the manufacture[r],” according to a memo sent to Boone Police Chief Dana Crawford.
The violations that did result in written warnings (no fine) are as follows:
- On Friday, April 13, Boone Police Department responded to Paolucci’s at 11:22 p.m. The average decibel level in a one-minute period was 71.35 dba, and the highest level was 77.30 dba. The limit at this day and time was 70 dba. Music and “parties, gatherings” was noted on citation.
- On Friday, April 27, Boone Police Department responded to Boone Saloon at 12:41 a.m. The average decibel level in a one-minute period was 68.17 dba, and the highest level was 74.60 dba. The limit at this day and time was 60 dba. Music and “yelling, shouting” was noted on citation.
- On Friday, April 27, Boone Police Department responded to Boone Saloon at 1:14 a.m. The average decibel level in a one-minute period was 63.09 dba, and the highest level was 70.00 dba. Boone Saloon was issued second warning of night. The limit at this day and time was 60 dba. Music and “yelling, shouting” was noted on citation.
