Feb. 21, 2014. The Boone Town Council adopted changes to the town’s towing ordinance on Thursday, according to town clerk Kim Brown.
At its Tuesday meeting, Town Attorney Sam Furgiuele, who was directed by the council in January to prepare amendments to town policy relating to non-consensual towing and violation penalties, asked to defer any action until Thursday because he wanted to give the District Attorney’s Office a chance to review and offer any input into the changes.
On Thursday, the changes approved include:
- No towing company may attach a towing vehicle to an occupied vehicle, tow an occupied vehicle, nor demand payment pursuant to ordinance in connection with an occupied vehicle.
- The ordinance also states that towing companies are not authorized to attempt to impede or block an occupied vehicle from being removed from a parking space or lot.
- A parking control device may not be applied to an occupied vehicle
