On May 12, deputies with Avery County Sheriff’s Office obtained a search warrant at 5200 N.C. 105 South #6 and found a marijuana grow operation with the assistance of a K-9 unit. The sheriff’s office “received information” prior to the warrant and arrests are pending, according to the release.

In response to information received about a possible grow operation at a residence on Adams Apple Drive off of N.C. 105, the Avery County Sheriff’s Office obtained a search warrant and located an indoor grow operation at the residence of James Smith, 50, of Banner Elk, four days later on May 16.

Smith was charged with growing and possessing marijuana and maintaining a dwelling. Smith is currently being held at the Avery County jail under a $25,000 bond.
