At bar closing time at about 2 a.m. Thursday morning, the Boone Police Department responded to a call from Café Portofino on Rivers Street regarding a male under the influence brandishing a handgun, according to Boone Police Department spokesman Shane Robbins.

By the time an officer reached the restaurant and bar, the suspect, Kenneth Chase Franks, 25, of Race Track Drive in Bunn, had already left the scene, driving west on Rivers Street. The officer then proceeded in that direction and pulled the vehicle over near the intersection of Poplar Grove Road and Poplar Grove Road Connector.

Franks was arrested and charged with misdemeanor assault by pointing a gun, misdemeanor driving while impaired and misdemeanor expired registration violation. Franks was given $1,500 secured bond with a pending Watauga County District Court date of Dec. 17.
